Welcome to Daily Safety Moment. These Terms of Service ("Terms") govern your access to and use of the Daily Safety Moment website, including all pages, articles, calculators, forms, downloadable materials, PDFs, APIs, and other content or functionality made available through the website (collectively, the "Site").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Who We Are
Daily Safety Moment ("we," "us," or "our") provides workplace safety information, educational materials, and interactive tools intended to assist users in general safety planning and awareness.
2. Eligibility and Acceptable Use
You may use the Site only if you can form a binding agreement under applicable law and use the Site in compliance with these Terms and all applicable laws, regulations, and industry requirements.
You agree not to:
- use the Site for any unlawful, fraudulent, or misleading purpose;
- interfere with or disrupt the Site or its infrastructure;
- attempt to gain unauthorized access to any part of the Site or related systems;
- copy, scrape, reproduce, republish, or commercially exploit substantial portions of the Site without prior written permission, except as allowed by law;
- upload or submit malicious code, false data, or content that infringes the rights of others;
- rely on the Site as the sole basis for safety, engineering, legal, medical, regulatory, or operational decisions.
3. Educational and Informational Purpose Only
The Site is provided for general informational and educational purposes only. Content on the Site, including articles, safety topics, blog posts, calculators, forms, checklists, generated PDFs, suggested controls, and other materials, is not guaranteed to be complete, current, accurate, or suitable for your specific workplace, jobsite, equipment, workforce, or hazard conditions.
Use of the Site does not create any professional-client, consultant-client, engineer-client, attorney-client, medical-provider, or other advisory relationship.
4. No Professional Safety, Engineering, Legal, or Medical Advice
The Site does not provide professional safety consulting, engineering, legal, medical, industrial hygiene, or regulatory compliance advice. Any information or output provided through the Site is a general aid only and must be independently reviewed by qualified professionals familiar with your specific circumstances.
You are solely responsible for determining whether any information, calculation, recommendation, or generated document is appropriate for your use and compliant with applicable laws, standards, manufacturer instructions, site conditions, and employer policies.
5. Tool and Calculator Disclaimer
The Site may include interactive tools and calculators, such as safety calculators, hazard-planning tools, risk assessment tools, job planning forms, and downloadable or printable records.
You acknowledge and agree that:
- tool outputs are estimates, examples, summaries, or planning aids only;
- outputs depend on the accuracy and completeness of information entered by the user;
- tools may use assumptions, simplified logic, generalized standards, or incomplete datasets;
- tools may contain bugs, calculation errors, omissions, downtime, or outdated references;
- outputs may not reflect site-specific variables, environmental conditions, equipment limitations, human factors, jurisdiction-specific rules, employer procedures, or the latest legal or technical requirements;
- generated PDFs, forms, and records are convenience documents only and are not official compliance determinations or certifications.
You must independently verify all inputs, calculations, assumptions, outputs, and resulting decisions before relying on them.
6. No Warranty of Compliance or Fitness for a Particular Purpose
We do not warrant that use of the Site or any tool, output, form, or PDF will:
- satisfy OSHA, MSHA, NFPA, ANSI, NIOSH, DOT, EPA, state, local, international, or industry-specific requirements;
- make any workplace, jobsite, task, process, or activity safe;
- prevent incidents, injuries, illnesses, fatalities, property damage, citations, claims, or losses;
- satisfy documentation, training, inspection, engineering, permitting, or audit obligations;
- be appropriate for your specific industry, workforce, equipment, or operational environment.
7. User Responsibility and Assumption of Risk
You assume all risk arising from your access to and use of the Site. You are solely responsible for:
- your reliance on any Site content or tool output;
- verifying all calculations and recommendations;
- assessing site-specific hazards and conditions;
- complying with all applicable laws, codes, standards, and internal policies;
- obtaining review and approval from qualified professionals where needed;
- implementing, supervising, and monitoring safe work practices.
If you use the Site in connection with hazardous work, construction, industrial operations, confined spaces, lifting, fall protection, excavation, electrical work, crane operations, or other high-risk activities, you acknowledge that improper reliance on generalized online tools can result in serious injury, death, property damage, or regulatory consequences, and that you bear sole responsibility for final decisions and field implementation.
8. Disclaimer of Warranties
To the maximum extent permitted by law, the Site is provided on an "as is" and "as available" basis, with all faults and without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, results, reliability, availability, security, and quiet enjoyment.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that defects will be corrected.
9. Limitation of Liability
To the maximum extent permitted by law, Daily Safety Moment and its owners, affiliates, officers, directors, members, managers, employees, contractors, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, business, goodwill, data, use, or other intangible losses, arising out of or relating to:
- your access to, use of, or inability to use the Site;
- your reliance on any content, tool, calculation, form, PDF, API response, or output;
- any errors, inaccuracies, omissions, or outdated information;
- any workplace incident, injury, illness, death, property damage, regulatory action, fine, citation, claim, or lawsuit;
- any interruption, bug, malware, or system failure;
- any third-party content, links, software, or services.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Site shall not exceed the greater of: (a) the amount you paid us, if any, to use the Site in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US $100).
Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so parts of this section may not apply to you to the extent prohibited by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Daily Safety Moment and its owners, affiliates, officers, directors, members, managers, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your use of the Site;
- your reliance on any Site content or tool output;
- your violation of these Terms;
- your violation of any law, regulation, or third-party right;
- any workplace decision, safety program, jobsite condition, documentation, or operational act or omission connected to your use of the Site.
11. Third-Party Sources and Links
The Site may reference or link to third-party websites, standards bodies, agencies, regulations, manufacturers, or other resources. Such references are provided for convenience only. We do not control and are not responsible for third-party content, availability, accuracy, products, services, or practices, and inclusion does not imply endorsement.
12. Intellectual Property
The Site and its content, design, text, graphics, branding, compilations, software, and tool logic are owned by us or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or internal business informational use.
You may not reproduce, modify, distribute, create derivative works from, publicly display, publicly perform, republish, download in bulk, reverse engineer, or exploit the Site except as expressly permitted by us in writing or by applicable law.
13. User Inputs and Submitted Content
If you submit information through forms, calculators, contact features, or other Site functionality, you represent that you have the right to provide that information and that it does not violate any law or third-party right.
You remain responsible for the accuracy, legality, and appropriateness of all submitted information. We are not responsible for errors in outputs caused by inaccurate, incomplete, or misleading user inputs.
If the Site permits you to generate, save, export, email, or download forms or PDFs, you are solely responsible for reviewing those materials before using, sharing, storing, or relying on them.
14. No Monitoring or Recordkeeping Duty
We do not undertake any duty to monitor your workplace, review your jobsite conditions, maintain your safety records, preserve generated outputs for your compliance purposes, or remind you of inspections, training, regulatory deadlines, or hazard controls. You are solely responsible for your own documentation, supervision, and compliance systems.
15. Availability, Changes, and Discontinuation
We may modify, suspend, restrict, or discontinue any part of the Site, including any tool, feature, content, or availability, at any time and without liability. We may also update calculations, assumptions, interfaces, descriptions, or references without notice.
16. Privacy
Your use of the Site is also subject to our Privacy Policy.
17. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms, created risk or possible legal exposure, or engaged in misuse of the Site.
18. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction and venue.
19. Severability
If any provision of these Terms is held unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
20. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly posted for particular features, constitute the entire agreement between you and us regarding the Site.
21. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms.
